Privacy and Personal Data

West Devon Borough Council takes your privacy seriously.

We will use your information for the provision of parking services and civil enforcement and the discharge of the Council’s Statutory obligations under the Health and Safety at Work Act. This notice sets out what we will do with your personal information and who we may share it with in respect of the above.

What information about you do we collect?

We collect the following information: 

• Name 
• Address 
• Contact details, such as email address and phone number 

How do we collect information about you?

Relevant personal data will be collected: 

• Directly from you on our website, over the phone 
• In person from one of our Civil Enforcement Officer (CEO) 
• From paperwork provided by you 
• From body-worn video cameras worn by our CEOs. 
• From the DVLA

How will your personal data be used?

Your personal data will be used in the following ways: 

• To enable you to purchase a Pay and Display ticket, or paid by phone parking session. 
• So you can apply for parking permits or dispensation permits. 
• So you can pay a Penalty Charge Notice. 
• To challenge and respond to Penalty Charge Notices. 
• To recover unpaid Penalty Charge Notices. 
• To allow us to enforce parking contraventions and other enforcement purposes. 
• To enable us to discharge our statutory obligations under the Health and Safety at Work Act. 

The Legal basis for processing your data

Your personal data is processed under the following legal bases: 

• Article 6 1(c) processing is necessary for the compliance with a legal obligation to which the controller is subject. Local authorities are legally obligated to fulfil a statutory obligation, such as those conferred on the Councils under; the Health and Safety at Work Act 1974, the Road Traffic Regulation Act 1984, the Civil Enforcement of Road Traffic Contraventions (Representations and Appeals) (England) Regulations 2022 and Part six of the Traffic Management Act 2004. 
• Article 6 1(e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. Local authorities are required to administer parking services under; the Health and Safety at Work Act 1974, the Road Traffic Regulation Act 1984, the Civil Enforcement of Road Traffic Contraventions (Representations and Appeals) (England) Regulations 2022 and Part six of the Traffic Management Act 2004.as a public task. 

Who will your personal data be shared with?

If we feel that it is necessary to share your personal data with professionals to ensure you or someone you work with is safeguarded from harm, we rely upon the provisions of the Safeguarding Vulnerable Groups Act 2006 and Children Act 1989 and 2004. Where it is necessary to share medical or social care information for these purposes, we rely upon article 9(2)(h) of the General Data Protection Regulation (information necessary for medical diagnosis, the provision of health or social care or treatment or the management of health or social care systems). 

The data you provide may be disclosed to other enforcement agencies for enforcing parking contraventions or to agents of the Councils during the course of debt collection. It may also be disclosed to other departments within the Councils to assist in our delivery of other statutory duties, or external parties for related enforcement purposes or as required by law. 

We may also need to share some personal data about you, so that we can support third party organisations to discharge their regulatory requirements. This includes organisations such as; 

• The data protection regulator (the Information Commissioner’s Office) 
• The Care Quality Commission 
• Traffic Commissioner 

We may also share information to enable us to comply with court orders and other legal obligations. If this is necessary, we will only share the minimum amount of personal data needed for this purpose. 

The Councils will never sell your data to anyone else. 

Transferring of data outside of the EU

Your data will not be transferred outside of the EU. It will be securely stored electronically within the UK only, unless it was necessary for safeguarding or for the prevention and detection of crime. 

Length of time we keep your information 

The Councils will retain personal data for no longer than 6 years from when the record was created.

Data Processors

The Councils use parking enforcement software to manage our car parks and parking enforcement. This software is provided by Taranto, who act as a data processor on behalf of the Councils. Further information on Taranto can be found on their website.
