Privacy Notice - Housing Needs Survey

West Devon Borough Council ("The Council") take your privacy seriously.

We will use your information in order to assess the housing needs of the named area. This notice sets out what we will do with your personal information and who we may share it with in respect of the above.


What information about you do we collect?

  • Personal data - such as your name, address, email and telephone number
  • Whether you identify as in existing housing need within your named area, or identify future housing need within your household
  • Whether you can identify any potential sites of interest for future affordable housing developments

No data will be published which can identify an individual.


How do we collect information about you?

Relevant personal data will be collected:

  • Directly from you (e.g. from asking you to complete an online or printed form, or speaking to you on the phone or face to face, or from emails sent to South Hams or West Devon members).

How will your personal data be used?

Your personal data will be used in the following ways:

  • To identify households with existing housing need
  • To identify households with projected housing need
  • To identify households with local connection to the named area
  • To identify the affordability of housing in the named area
  • To identify any specialist housing needs
  • To recognise potential sites of interest for future developments

The Legal basis for processing your data

Your personal data is processed under the following legal bases:

Article 6 1 (a) the data subject has given consent to the processing of his or her personal data for one or more specific purposes

We collect, use and share certain data about you on the basis that you have given us your consent to do so. You may withdraw your consent and ask us not to process your data at any time, but this may affect any improvement to the housing needs within the named area.

Article 6 1 (b) processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.

In order to be part of the scheme to understand housing needs within the named area, we require certain personal data from you. Without this personal data we cannot gauge interest in whether improvements in housing supplies are desired or whether people within the communities are interested in driving the project forward for reducing housing needs within the named areas.

Article 6 1 (c) processing is necessary for compliance with a legal obligation to which the controller is subject.

We are legally obligated to assess housing need within our area under, but not limited to the following UK laws:

  • The Crime and Disorder Act 1998
  • The Children Act 1989
  • The Housing Acts 1988, 1996, 2002, 2004
  • The Homelessness Reduction Act 2017
  • The Landlord and Tenant Act 1987
  • The Protection from Eviction Act 1977

Article 6 1 (e) processing is necessary for the performance of a task carried out in the public interest.

We carry out a public task of assessing housing need under, but not limited to, the following UK laws:

  • The Crime and Disorder Act 1998
  • The Children Act 1989
  • The Housing Acts 1988, 1996, 2002, 2004
  • The Homelessness Reduction Act 2017
  • The Landlord and Tenant Act 1987
  • The Protection from Eviction Act 1977

Who will your personal data be shared with?

We will share your personal data with the following:

We sometimes need to share your data within the Councils, or with other organisations. We will only share your data when necessary and when the law allows us to. We will always share the minimum data required. For matters relating to this privacy notice, we may need to share your personal data with:

  • Devon Home Choice and landlord partners
  • Landlords - housing associations, registered providers and private landlords
  • Elected members and MPs (as your representative)
  • Community Land Trusts
  • Other local authorities
  • Educations providers
  • Safeguarding boards
  • Funding bodies  

The Councils will never sell your data to anyone else.


Transferring data outside the EU

Your data will not be transferred outside the EU. It will be securely stored electronically within the UK only, unless it was necessary for safeguarding or for the prevention and detection of crime.


Length of time we keep your information

The Councils will retain personal data securely for a period of 5 years after which it will be destroyed. The data is retained for 5 years as this is the length of time that the housing needs survey is valid for.
