Additional fees may be required at the planning department’s discretion depending on the level of information required

Help to resolve planning history questions

Includes a full check of the planning and planning enforcement history, a site visit to view the development, a 1-hour meeting if it is deemed necessary by the case officer, any necessary in house consultations, written confirmation of the outcome, a formal decision as to whether enforcement action will be taken and/or confirmation of steps required to remedy the situation, if any.  Response will be provided in 20 working days in most cases (can be extended by agreement if further consultation or investigation is required). Use this quick service if you are buying or selling a property/land and a planning query arises through the conveyancing process.  For example, unauthorised works have been discovered or planning conditions have not been complied with.

 

Engagement of specialist advise from an external specialist required to provide guidance to the LPA

Quoted fee of the specialist plus a 10% administration fee

Where the guidance is required of an external specialist such as a retail consultant or agricultural specialist to enable either the provision of pre-application advise or advise on an application the fee for this will be passed to the applicant

 

Design Review Panel

The fee will be calculated with the selected Design Review Panel and be paid directly to the Organisation.

While the scheme's consideration should be coordinated by the applicant this should include the engagement of the Case Officer in the process including attending both the meeting and any site visit. The advice of the panel should be made concurrently available to the Case officer and the applicant by the Panel.

This service is at the discretion of the Head of Development Management to enable a scheme to be amended and re-consulted upon and re-advertised prior to the determination of the application notwithstanding the position set out in the Planning Charter. Applications which are the subject of a Planning application PPA for their determination are exempt from this charge.

 

Assessment of the viability of developments

Where a viability appraisal is received as part of a planning application submission or at pre application stage this will require an assessment to be undertaken to verify the assumptions being made. The cost for undertaking this assessment will be met by the developer.

 

Planning Performance Agreement planning conditions extension

Householder permissions £34 x the number of conditions requiring further consideration.

All other permission £116  x the number of conditions requiring further consideration

In line with the Planning Charter applications will be considered based upon information submitted, where additional detail is required to satisfy a condition rather than refusing the condition discharge application further information can be submitted and re-consulted upon prior to determination

 


Planning Performance Agreements

In addition to the areas set out above to be able to be subject to a Planning Performance Agreement (PPA) the Council is willing to consider their use in other circumstances by mutual agreement. Where a PPA is in place it will be made available on the relevant principle applications in line with the council's publication procedure e.g. where a pre-application is subject to a PPA it will be made available when the pre-application becomes public at the point of an application submission.

Where a PPA is relating to a site or long term development scheme the PPA will be shown on the pre-application, application and any subsequent application e.g. S73 application, it will not be shown on condition discharge applications or Non-Material Amendment applications

While the Council's standard approach will be to agree a bespoke fee for a PPA dependent on the scope required it will (in specific cases), also be willing to agree staged payments. These will be paid in advance of specific agreed milestones. The Council will also be willing to agree a process where the costs associated with processing the PPA will be payable on a day rate basis +VAT, this will be based upon the principal case officer's time and any core associated officers to a project such as urban designer or landscape officer whose involvement is specific to the scheme plus 15% fee to cover administration of the agreement and the involvement of other consultees. Where such an agreement is in place it will be subject to a minimum upfront payment of £2500 and subject to a regular agreed invoicing process. The fees set out will be non-negotiable and failure to pay will be considered to terminate the agreement. For longer term PPA these will need to be re-agreed on at least an annual basis.

A further £200   is payable for each additional Section 106 required to be checked.

An additional £150 to be paid if a site visit is required.

Where a S106 agreement refers to the BCIS Index published figure this will be taken to be the latest published figure on their website whether identified as provisional or final. 

All legal fees will be subject to separate charges directly with the Legal Services team including the drafting of S106 agreements.


Enforcement Matters

If the Council has been in contact with you recently to investigate a breach of planning control and determined not to take any action you will be verbally advised of the outcome.  Use this service if you require a letter of comfort confirming the Council’s decision on the matter on a case closed in the last 12 months.  

A further £200  is payable for each additional Breach.

Confirmation of closure of enforcement case (Planning Unit Created)  where it was found not expedient to take action. (available for a 12-month period following closure of the case) and or confirmation that the Council does not intend to take enforcement action against a breach.

If the Council has been in contact with you recently to investigate a breach of planning control and determined not to take any action you will be verbally advised of the outcome.  Use this service if you require a letter of comfort confirming the Council’s decision on the matter on a case closed in the last 12 months.  

 

Confirmation of compliance with Enforcement Notice or Breach of Condition Notice (including site visit)

Includes a site visit, full check of the enforcement case and written confirmation of the outcome. Use this service if you require confirmation that an Enforcement Notice served by the Local Planning Authority has been complied with.

 

Confirmation of compliance with listed building consent (available for a 12-month period following completion of the development)

Includes a site visit to compare the development against the plans and written confirmation of our findings. Only available within 12 months of completion. Use this service if you have completed a listed building project and you wish to sell the property.

Site Visits

Site visits where required will be considered to be for no more than an hour of Officer time to visit the site and undertake any addition meetings. If applicant or officers consider additional time is required this must be agreed in advance and the additional time paid for at a rate of £80 per hour per officer.

If additional Officers are required in addition to the case officer for a site visit this will be charged at £80 per hour per additional Officer.
